Terms and Conditions

General conditions for using HOSTON SRL services

01. Definitions and Contracting Parties

This document constitutes the agreement between HOSTON SRL (hereinafter referred to as "Provider" or "HostON"), registered at Str. I.L. Caragiale, no. 47, Mărășești, Vrancea, 625200, Romania, CUI RO38066444, Reg. No. J39/357/2017, and the Client — the natural or legal person who purchases or uses HostON.ro services.

By accessing the website or purchasing any service, the Client expressly accepts these Terms and Conditions. If you do not agree with these terms, do not use HostON services.

02. Services Offered

HostON provides the following services:

  • Web Hosting (Shared, WordPress, eCommerce, Performance)
  • VPS Servers and Dedicated Servers
  • Domain registration, transfer and renewal (via partner registrar TES Domains)
  • SSL Certificates
  • Professional Email Hosting
  • Reseller Services

Technical specifications for each service are detailed on product pages and may be modified with 30 days prior notice.

03. Service Activation and Duration

Services are activated within 24 hours of payment confirmation. Service duration is as specified at order (monthly or annual).

Upon expiration of the contractual period, the service is automatically suspended if not renewed. Data is retained for 14 calendar days after suspension, after which it may be permanently and irrecoverably deleted.

HostON will notify the Client at least 7 days before service expiration by email. The Client is responsible for maintaining a valid email address on their account.

04. Availability and SLA (99.9% Uptime)

HostON guarantees a minimum availability of 99.9% annually (equivalent to a maximum of ~8.7 hours downtime/year) for hosting and VPS services.

The following periods of unavailability are excluded from the availability calculation:

  • Planned maintenance (notified at least 24 hours in advance)
  • Cyber attacks (DDoS, hacking) against HostON infrastructure or the Client
  • Upstream provider failures (internet, electricity, data center)
  • Client actions or omissions (misconfiguration, faulty scripts, intentional overload)
  • Force majeure (earthquakes, floods, pandemics, government actions)
  • Domain or DNS issues outside HostON's control

05. Pricing and Billing

All displayed prices are excluding VAT. 21% VAT applies to individual and corporate clients in Romania without a valid intra-community VAT number.

Invoices are issued electronically and sent by email. Payment is processed through Netopia Payments (bank card, online transfer).

Promotional codes apply only to the first invoice for that service. At renewal, the price reverts to the standard rate published on the website.

HostON reserves the right to modify prices with 30 days prior notice by email. Existing prices are not modified during the current contractual period. Non-response within 15 days of notification constitutes tacit acceptance of the new prices; the Client may refuse and terminate the contract without penalty within this period.

06. Late Payment Penalties

Invoices that remain unpaid for more than 7 calendar days past the due date will result in:

  • Automatic service suspension (website offline, email suspended)
  • Late payment penalties of 0.1% of the invoice value per day of delay

If non-payment persists for more than 30 days after suspension, HostON is entitled to terminate the contract, delete data, and recover the debt through legal means, including referral to a debt collection agency or court.

The Client shall also bear court and debt recovery costs in case of litigation.

07. Client Obligations

The Client agrees to:

  • Provide accurate, complete and up-to-date information at registration, and update it within 72 hours of any change
  • Use services in accordance with the Acceptable Use Policy (AUP) — details at AUP page
  • Pay invoices within the specified deadline
  • Not transfer service access without HostON's written consent
  • Maintain the security of access credentials (passwords, SSH keys, API tokens)
  • Create regular backups of important data — HostON backups are operational (for recovery after server-level incidents) and do not replace the Client's own responsibility for maintaining data copies

The Client is solely responsible for content published on HostON servers, including compliance with copyright law, data protection legislation, and any other regulations applicable to the published content.

08. Provider Obligations

HostON agrees to:

  • Ensure service availability per the published SLA (99.9% annual uptime)
  • Notify the Client of planned maintenance at least 24 hours in advance
  • Provide technical support during business hours (Mon–Fri 09:00–18:00)
  • Maintain confidentiality of Client data in accordance with the Privacy Policy and DPA
  • Perform daily operational backups per the selected plan specifications
  • Respond to abuse reports within 2–5 business days

09. Account Management and Access Recovery

The Client is solely responsible for all actions performed from their account, including those by persons to whom they have granted access.

Lost access recovery: if the Client can no longer access the account (forgotten password, inaccessible email, etc.), HostON will verify the requester's identity through:

  • Individuals: copy of ID card/passport
  • Legal entities: registration certificate + proof of status as legal representative

Insolvency or liquidation: in case of the Client's insolvency, account access may only be transferred to the officially appointed judicial administrator, upon presentation of relevant court documentation.

HostON will not transfer account access to third parties (including heirs or employees) without appropriate legal documentation.

10. Premium Domains

Certain domains are classified as "Premium" by the TLD registry and have prices significantly different from the standard rates displayed on the website. Before processing payment for a premium domain, HostON will notify the Client of the actual price and request express order confirmation. Payment for a premium domain is processed only after the Client's explicit confirmation of the actual price.

11. Guarantee and Refunds

HostON offers a 30-day money-back guarantee for all hosting plans, applicable to the first invoice for new clients.

Not eligible for refund under the money-back guarantee: registered domains, issued SSL certificates, VPS/Dedicated plans, renewed services.

Refund requests should be sent to info@hoston.ro and are processed within 14 business days.

Individual consumers additionally benefit from the legal 14-day right of withdrawal under OUG 34/2014 — full details at Return Policy page.

12. Suspension and Termination

HostON may suspend or terminate service without prior notice in case of:

  • Invoice unpaid for more than 7 days past the due date
  • Use of service for illegal activities, spam, phishing or malware
  • Cyber attacks launched from/through the Client's account
  • Intentional server overload (resource monopolization)
  • False identity data provided at registration

The Client may terminate the service at any time through the control panel or by email to info@hoston.ro, without penalty. Prepaid amounts are not refunded upon voluntary termination (exception: 30-day guarantee and 14-day withdrawal right per OUG 34/2014).

Upon termination or expiration, data is retained for 14 days and then permanently deleted.

13. Limitation of Liability

HostON's total liability to the Client, regardless of the legal basis of the claim, is limited to a maximum of 50% of the value of services paid in the last contractual period in which the incident occurred. HostON is not liable for:

  • Loss of profit, revenue or data caused by downtime
  • External cyber attacks against the Client's website or infrastructure
  • Issues caused by the Client's code, configuration or actions
  • Indirect, incidental or special losses of any nature
  • Force majeure (earthquakes, floods, pandemics, government actions)
  • Errors or unavailability of third-party services (domain registrars, payment processors, CDN providers)

14. Intellectual Property

Content published by the Client on HostON servers remains the Client's property. HostON claims no rights over it. The Client warrants that they hold the necessary rights to publish the content and will indemnify HostON for any damages resulting from third-party claims regarding published content.

15. Subcontracting

HostON has the right to partially subcontract service delivery (e.g. data center, domain registrars, DDoS protection) without the Client's prior consent, provided that HostON remains responsible to the Client for the quality of subcontracted services. The list of main sub-contractors is available in the DPA Agreement.

16. Privacy and GDPR

Processing of the Client's personal data is carried out in accordance with the Privacy Policy, in compliance with GDPR (EU Regulation 2016/679).

Business clients (Data Controllers) who store their customers' data on HostON servers are covered by the Data Processing Agreement (DPA), pursuant to GDPR Art. 28.

17. Amendment of Terms

HostON may amend these terms with 30 days advance notice by email. Continued use of services after this period constitutes acceptance of the new terms. If you do not agree with the changes, you may terminate the contract without penalty within the notice period.

18. Governing Law and Disputes

This contract is governed by Romanian law. Any dispute shall be resolved amicably, or through alternative dispute resolution bodies (ANPC/SAL) or the European online platform (SOL).

If amicable resolution is not possible, the competent court is the one at the Provider's registered address (Mărășești, Vrancea).
