Acceptable Use Policy

The rules that keep shared servers fast and secure for all customers: what we do not host, how you use resources and what happens in case of a breach.

Purpose of the policy

This policy is part of the Terms and Conditions and applies to all HostON services: web hosting, reseller, VPS, email, domains. For accounts created by resellers, the reseller is responsible for its customers’ compliance with it.

Prohibited activities

The following may not be hosted, sent or promoted on the HostON infrastructure:

  • spam and unsolicited bulk email, including purchased address lists;
  • illegal content, including child sexual abuse material, which is reported to the authorities immediately;
  • phishing, online fraud or impersonation of persons or companies;
  • malware, viruses, botnets or other malicious software;
  • DDoS attacks, flooding, port scans, brute-force attacks or interception of other people’s traffic;
  • cryptocurrency mining without our prior written consent;
  • content that infringes copyright or trademarks (for example unauthorised IPTV, pirated software, licence keys, torrent trackers for pirated content);
  • pornographic content or sexually explicit material, as well as the promotion of escort services, in any form;
  • gambling without a licence from the Romanian National Gambling Office (ONJN) or the competent authority;
  • human trafficking, sexual exploitation or organised prostitution;
  • sale of medicines or controlled substances without the legal authorisations;
  • pyramid schemes, Ponzi schemes or other deceptive financial schemes;
  • content that promotes terrorism or violent extremism;
  • use of artificial intelligence for illegal content, deepfakes, impersonation or fraud;
  • anonymous proxy servers, public VPN services or Tor exit nodes, without our prior written consent.

We assess each case objectively and proportionately, taking into account the fundamental rights of everyone involved, including freedom of expression.

Fair use of resources

Shared hosting plans have limits for CPU, memory, processes and inodes, shown on the page of each plan. Within these limits, we ask you:

  • to keep a reasonable average CPU usage, without permanent peaks at the plan limit;
  • to optimise queries and the number of simultaneous database connections;
  • not to use the hosting only as storage space or external backup, without an active website or application;
  • to ask for our consent before sending high-volume commercial email.

We notify you of repeated overuse and suggest solutions: optimisation, caching or moving to a suitable plan. On a VPS, resources are dedicated, but the rules on content and attacks apply in the same way.

Responsibility of resellers

Resellers are responsible for the content and conduct of the accounts created under their account. We do not proactively check these accounts, but we may act directly on an individual account in case of a breach. Repeated breaches, or breaches not resolved in time by the reseller, may lead to suspension of the reseller account, after a warning.

Backup and responsibility

On hosting plans, we make automatic daily backups (JetBackup), which you can use from cPanel. Our backups are meant for recovery after incidents; we recommend that you also keep your own copies outside the HostON servers.

What happens in case of a breach

  1. 1WarningWe inform you by email of what we have found and ask you to fix it within a reasonable time.
  2. 2RestrictionIf the problem is not resolved, or immediately in serious cases (manifestly illegal content, an ongoing attack, a risk to other customers), we may block a file or a page or suspend the service.
  3. 3Statement of reasonsYou receive a clear explanation: what was restricted, why, on what grounds, whether the decision was based on a notice and how you can appeal it.
  4. 4AppealYou can appeal the decision at abuse@hoston.ro. If you fix the problem, we reactivate the service.
  5. 5TerminationFor serious or repeated breaches, we may terminate the contract. Activities that may constitute criminal offences are reported to the authorities.

In case of termination due to the Customer’s fault, HostON may retain the amounts corresponding to the period already provided and any proven damages. The statutory rights of consumers (including the right of withdrawal) are not affected.

Notice procedure (DSA Art. 16), including copyright

Anyone can report illegal content hosted by HostON, including copyright or trademark holders, under Art. 16 of Regulation (EU) 2022/2065 on digital services (Digital Services Act). Use the reporting form or write to abuse@hoston.ro. A complete notice contains:

  1. 1the exact address (URL) of the content;
  2. 2a sufficiently substantiated explanation of the reasons why you consider the content illegal; for copyright, the protected work and the right you hold;
  3. 3the name and email address of the notifier (not required for child sexual abuse material);
  4. 4a statement that the information in the notice is, in good faith, accurate and complete.

We confirm receipt of the notice, review it without undue delay and inform you of our decision. The affected customer receives a statement of reasons and can respond or appeal at abuse@hoston.ro; if they show that the restriction was wrong, we restore the content.

Manifestly unfounded notices sent repeatedly may lead to notices from the same person being temporarily disregarded, after a warning. Customers who repeatedly infringe the rights of others may have their contract terminated.

Yes. Business websites, online shops, blogs and lawful web applications are exactly what hosting is for. Only the illegal or abusive activities in the list are prohibited.

We let you know and suggest solutions: optimisation, caching or a suitable plan. We suspend only if the server and other customers are affected and the problem cannot be solved otherwise.

Through the form on the Report illegal content page or at abuse@hoston.ro, with the exact URL, the protected work, your right and the good-faith statement. The procedure follows Art. 16 of the DSA.

Usually yes, with a deadline to fix the problem. Only in urgent cases do we suspend immediately, and then we send you the reasons for the decision and how you can appeal it.

Yes, to subscribers who have given their consent and in reasonable volumes. For large commercial mailings, ask for our consent first or use a dedicated email marketing service.
